Vessel is privately owned in the company structure run as a charter boat but almost entirely being chartered by the owner for personal sailing. She is not a charter yacht booked in to a fleet for mass commercial bookings.

Our understanding of the possible sale scenarios:

1 – If bought by a company (not wanting to purchase the Polish holding company) the VAT is not applicable as the status is considered paid – all leasing and taxes paid, Vat was paid and reclaimed.

2 – If bought by a company (and wants to purchase the Polish holding company) the VAT is not applicable, status remains as it is now. Vat was paid and reclaimed.

3 – If bought by a private individual resident in the EU the VAT she can be sold by the company as VAT paid, but VAT has to be charged as it was reclaimed.

4 – If bought by a private individual NON-EU resident/citizen then the yacht can be sold as normal, the evidence of the tax status is irrelevant, although evidence of payment.
